According to the current legislation of the Czech Republic, the realisation of surrogacy in the Czech Republic is not prohibited or regulated by the Law. Therefore, according to the Civil Code, the registration of the birth of a child born as a result of surrogacy is carried out according to the general rules. There is also a restriction prohibiting commercial basis for surrogacy. In our programs, participation takes place within the framework of the altruistic intentions of the surrogate mother. There is no financial gain for the surrogate mother, therefore we strictly fulfil the requirements of the current legislation of the Czech Republic.

No. We are against deception. And it is not necessary. In Czech law, a child born to a genetic mother or born to a surrogate mother is registered in the same way. The following persons are recognized by the Czech state authority (Matrika): the woman who gave birth to the child and the father. The father confirms his paternity before the state authorities in the presence of a court interpreter. Nobody here is interested in your relationship with each other. There is the fact of the birth of a child, which must be registered and documented solely on the basis of the only law in force - the Czech Civil Code.

No. You cannot have any problems. Recognition of paternity and state registration of the child's birth are carried out strictly according to the current legislation of the Czech Republic. You receive a birth certificate (rodný list). The surrogate mother signs an application and a power of attorney at a Czech notary, which will allow you to return home and register the child with your state authorities without any problems. After registering the birth of the child in your country of citizenship, you can begin the process of a simplified adoption of the child by the wife of the child's legal father. To do this, you will have all the necessary surrogate documents and notarised statements waiving any maternal rights and custody of the child. The implementation of the surrogacy program in the Czech Republic is non-commercial in relation to you and the surrogate mother. In other words, by concluding a contract with you, the Clinic assumes full responsibility for financial compensation for the special condition of the woman carrying the pregnancy. You, for your part, do not pay anything to the woman carrying the pregnancy for you, as it is all included in the total cost of your health care package.

Yes, it is possible. You should take into account that there may be a current influence of the epidemiological situation or obstetric situation. But in general there are no obstacles. For the maternity hospital it is just another labour, where there is a woman giving birth to a child in the delivery room and you as the father of this child are next to her. It is important to add that the internal regulations of the maternity hospital stipulate that only one person can be present at the birth. In this regard, we always recommend to potential parents to have a Czech pregnancy coordinator present at the birth, because the surrogate mother does not know the Czech language, so his support and knowledge of the language will greatly help a comfortable labour and birth in general, from the psycho-emotional side.

Our surrogacy program with birth in the Czech Republic has a fixed cost. It is carried out with the full legality of the legal process and with the receipt of European-type documents. But surrogacy in Colombia, Mexico or Albania is carried out in the complete absence of the law regulating surrogacy in the country of the program. Just as in the Czech Republic, the genetic father and surrogate mother are listed on the child's birth certificate. On the plus side, there may be a more convenient location and the sea. There was such an investigation. In the course of it, with the consent of those involved, more than 1000 DNA tests were carried out on the parents, children and surrogate mums. In all cases, without exception, it was confirmed that the parents and children were related and that there was no genetic link to the surrogate mothers. This operation was initiated by the Czech Pirate Party ‘Česká pirátská strana, Piráti’ (represented by Olga Rizterova), who wanted to make some PR for herself. The party activists found like-minded people in Ukraine. But after all the DNA tests, their project failed miserably. Millions of euros of European taxpayers were spent. After failed provocations in Ukraine and unsuccessful pressure on our group of clinics in the media space, this operation was stopped. At the initial stage of this investigation, some unscrupulous agencies tried to earn ‘points’ on the hype, providing distorted information and reprinting rumours from each other. Therefore, our group of clinics is already preparing claims to protect the good name of our company. This investigation has only further confirmed the legitimate and transparent work of our group of clinics, as well as the high standards of medicine and full compliance with ethical norms.

As of today, the Czech authorities have not adopted a law regulating surrogacy, the bill has been under consideration for a long period of time. The representatives of the Czech parliament and the working committee do not have a clear idea of how surrogacy should be regulated and the practical implementation of the process itself.
