
Portugal allows GPA for medical reasons

Surrogacy has been allowed in Portugal since 2016. The main aspect that complicates and delays the surrogacy process in Portugal is the regularity of the examination of applications by the National Council for Medical Assistance for Childbearing.
This has made the country a centre of reproductive tourism for residents of neighbouring Spain, where this assisted reproductive procedure is illegal. The common cultural and linguistic environment, as well as territorial proximity, helps to save money on travelling. Those who plan to carry out the full cycle of surrogacy in Portugal (from the creation of the embryo to obtaining the documents necessary for the legalisation of the newborn) need to be aware of the legal restrictions and subtleties:
- A residence permit is required.
- Surrogacy in Portugal is available only to married couples in official marriage when other methods of infertility treatment have not brought results.
- Authorisation orders from the Association of Doctors and the Association of Psychologists and authorisation for the procedure from the National Council for Medical Assistance for Childbearing are required.
- Commercial contracts with a surrogate mother are illegal: the gestational carrier is only compensated for expenses directly related to participation in the programme.
