The government of the Republic of Macedonia enacted the draft law about biomedical fertilization aid. The law was drafted by the Ministry of Health in accordance with the European directives and international conventions on protection of human rights in the sphere of biology and medicine.

It is for the first time that Macedonia created legal grounds in the field of medical science and genetics for performance of parental functions with the use of biomedical methods for the purpose of artificial fertilization of married couples who are unable to give birth to their own children.

Adult men and women who are officially married or have been living together for a long period of time are entitled to make use of the artificial fertilization methods, provided all previous infertility treatment attempts led nowhere. By and large, the law provides for the use of patients' sex cells for fertilization purposes. However, if it is found impossible through medical reasons, the law permits the use of donors' services and sets forth the relevant requirements to donors.

The work involving the use of donors' services, reproductive cells and embryos may be carried out by authorized health-care institutions that assumed obligations to provide all essential conditions, standards and adequate personnel for its fulfillment. They must guarantee proper protection of all personal medical and genetic data on donors, their families, as well as personal clients' data.
